MARGIN by Hemingway Advisory
Terms of Service
Last updated: November 2026
MARGIN is a service of Hemingway Advisory, a sole proprietorship owned by Lucas (Luke) Hemenway in Medford, Massachusetts (“we,” “us,” or “our”).
1. Acceptance of these Terms
These Terms govern your use of MARGIN (the “Service”). By requesting, receiving, buying or using an angle, you agree to these Terms. If you don't agree, don't use the Service.
If you act for a business, you confirm that you have authority to bind it to these Terms.
2. What the Service is
An “angle” is one specific thing a business can do about what a new customer finds when they look for what it does, or about its prices or costs, delivered in writing. Each one includes the angle itself, an estimate of what it's worth, the steps to make it, and the evidence behind it. We build angles from public information (your website, your Google listing, your reviews, and nearby businesses' public pages) using automated tools, including AI-assisted analysis, and a person reviews every angle before it reaches you.
- First angle. The first angle is free. There's no charge and no obligation to buy anything else.
- The other angles. The remaining angles (up to four) are sold together for a single one-time price: $199, $499 or $999 total. The price depends on what the five are estimated to be worth to your business in a year. You see the price before you pay.
- Delivery. We deliver paid angles by email within one business day of payment.
- Fewer than five. Every angle must pass our quality bar. If fewer than five pass, the page you buy from says how many you are getting, and the price is reduced in proportion before you pay.
- Reports. At day 30 and day 60 after delivery we look again at your pages, your reviews, and where you show up when a new customer looks for what you do, and send you a report on what changed. We can't see your bookings or revenue; those results come from you if you choose to share them.
- Membership plan pricing. Where we offer it, we price a membership plan for your business against the nearby plans that publish a price: the price, what's in it and why, and the sign-up page, written and ready to paste. It costs $499, paid once, and arrives within one week of payment. If you don't use it, tell us within 30 days of delivery and we'll refund you. One refund per business.
The Service doesn't include putting the angles in place for you, running your marketing, or legal, financial, accounting, tax or medical advice.
3. Estimates and your decisions
Dollar figures and counts in an angle are estimates, based on the assumptions shown in it. They are not promises of results. Whether to act on an angle, and how, is your decision. You stay responsible for your business's decisions, its pages, and its compliance with the rules of your profession.
Using the Service doesn't create a fiduciary, agency, partnership or employment relationship.
4. AI and third-party data
The Service uses automated systems and AI-assisted analysis, which can make errors or miss things. It relies on public and third-party sources such as search engines and business directories, which we don't control. We review angles before delivery, but we're not responsible for errors that come from those sources.
5. No warranties
To the maximum extent the law allows, the Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness and availability. We don't guarantee any business outcome, including revenue, bookings, rankings, visibility, traffic or profit.
6. Limitation of liability
To the maximum extent the law allows, we aren't liable for indirect, incidental, special, consequential, exemplary or punitive damages, including lost profits, lost revenue, business interruption, lost data or harm to reputation. Our total liability for any claim is limited to the amount you paid for the angles the claim relates to. This applies whatever the legal theory, including contract, tort, negligence and strict liability.
7. Indemnification
You agree to indemnify and hold harmless Hemingway Advisory, its owner and its contractors from claims, losses and expenses (including reasonable attorneys' fees) arising from:
- your use of the Service
- changes you make to your business or its pages based on an angle
- your breach of any law or regulation, including the rules of your profession
- your redistribution or publication of the angles
8. Payment and refunds
Everything we sell is paid for in advance, in US dollars, through Stripe. We don't see or store your full card number.
Refunds. If the angles you bought aren't worth it to you or you don't use them, email us within 30 days of delivery and we'll refund your payment. One refund per business.
If a technical problem stops delivery, we'll re-deliver or refund you, your choice. Because refunds are available on request, you agree to ask us for one before starting a chargeback.
9. Your use of the angles
You may use the angles you receive, including the written wording, in your own business: on your website, your listings and your other materials. Our methods, templates and the MARGIN brand stay the property of Hemingway Advisory.
You may not resell or redistribute the angles, publish them as your own product, or use them to train AI systems.
10. Private pages and opting out
We may send a business a free angle on a private page that search engines don't index. Ask us at hello@hemingwayadvisory.com and we'll take it down and stop contacting you.
11. Governing law
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles.
12. Binding arbitration; class action waiver
Any dispute arising from these Terms or the Service will be resolved by binding arbitration in Massachusetts under the rules of the American Arbitration Association, on an individual basis only. You waive any right to a jury trial and to take part in a class, collective or representative action. Judgment on the award may be entered in any court with jurisdiction.
13. Force majeure
We aren't liable for delay or failure caused by events beyond our reasonable control, including platform outages, API failures, internet disruptions, government action, cyberattacks or acts of God.
14. Severability, survival and entire agreement
If any part of these Terms is unenforceable, the rest stays in effect. The sections on liability, indemnification, your use of the angles, arbitration and governing law survive the end of these Terms. These Terms are the entire agreement between you and Hemingway Advisory about the Service.
